Acceptance of these terms

These terms and conditions govern all use of the gene-list.com website and of the software GeneList publishes for use with it. In these Terms, "you" and "your" refer to the person accepting these terms and the organisation, if any, on whose behalf they are acting. The Terms form a legally binding agreement between GeneList, Inc. ("GeneList") and you with respect to your use of gene-list.com.

By using or accessing gene-list.com you agree that you have read, understood, and agree to be bound by these Terms. GeneList may modify or replace any of these Terms at any time. Where a change is significant we will update the revision date at the top of this page. Your continued use of gene-list.com after a change constitutes acceptance of it, and you are responsible for reviewing these Terms from time to time. If you do not agree to all of these Terms, you must not use or access gene-list.com.

What GeneList does

GeneList takes a list of gene identifiers and returns, for each gene, links to independent research resources, together with gene annotations drawn from Ensembl. It is a navigation aid. It does not host, verify, curate or endorse the content of the resources it links to, and it is not a source of record for any annotation it displays.

Gene annotations are retrieved periodically from Ensembl BioMart and may be out of date, incomplete or superseded at any given moment. Assemblies and identifiers change between releases. Where accuracy matters, confirm anything you rely on against the primary resource, and cite that resource rather than GeneList.

gene-list.com is designed for research and informational purposes only. It does not provide medical advice or professional services and must not be relied upon as such. The information presented is not a substitute for professional medical help or advice; it is an aid to navigating research resources. A physician should always be consulted for any health problem, question or medical condition. Use of, or reliance on, information displayed through gene-list.com is at your own risk.

No warranty, and availability

gene-list.com is provided "as is" and "as available". GeneList makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness or currency of any annotation displayed, or of any link to another website. To the fullest extent permitted by law, GeneList disclaims all implied warranties, including those of merchantability, fitness for a particular purpose and non-infringement.

GeneList does not guarantee that the site will be available, uninterrupted or error free, and may change, suspend or withdraw any part of it, including any genome or any link to a resource, at any time and without notice.

Acceptable use

You may use gene-list.com for your own research, teaching and commercial work, and you may link to it freely. You may not use it in any way that interferes with its operation or with anyone else's use of it: in particular, do not submit automated requests at a volume or rate that places an unreasonable load on the service, and do not attempt to gain unauthorised access to any part of it or to any account, system or network connected to it.

If you want to reach GeneList programmatically, the supported ways are the URL format described on the About page and the R and Python packages published by GeneList. Bulk gene annotation is better taken from Ensembl directly, which is where GeneList takes it from.

Resources GeneList links to

The resources GeneList links to are operated by independent organisations and are governed by their own terms of use, licences and privacy policies. GeneList has no control over them and is not responsible for their content, availability or practices, nor for any data they collect about you. Following a link is your decision, and your use of the destination is a matter between you and its operator.

Some of those resources restrict commercial use, require attribution or require a licence. Complying with those conditions is your responsibility.

The R and Python packages

GeneList publishes client packages for R and Python that build gene-list.com links from a list of identifiers. They are open-source software distributed under the GNU General Public License, version 2 or later, and the terms of that licence govern your use of them, including the warranty disclaimer it contains. These Terms govern your use of gene-list.com itself when a package sends you there.

Lists you save or share

A search you run on gene-list.com is not retained by GeneList once the results are returned. If you use a feature that saves or shares a list, that list is stored so it can be retrieved, and anyone holding the link to a shared list can open it. Treat a shared link as public: do not put confidential, personal or identifying information into a gene list you save or share.

GeneList may remove saved or shared lists at any time and does not undertake to retain them.

Analytics, cookies and advertising

gene-list.com uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Cookies are placed on gene-list.com by Google as part of that service, and are used to help GeneList understand how the site is used. The information generated by those cookies about your use of gene-list.com, including your IP address, is transmitted to and stored by Google on its servers. Google uses this information to evaluate your use of the site, compile reports on site activity for GeneList, and provide other services relating to site activity and internet usage. Google may transfer this information to third parties where required to do so by law, or where those third parties process it on Google's behalf. gene-list.com also displays advertising served by Google. Google and its partners may use cookies to serve advertisements based on your prior visits to this and other websites. You can review and adjust how Google personalises advertising to you in Google Ads Settings.

By using gene-list.com you consent to the processing of data about you by Google in the manner and for the purposes set out above. GeneList does not control these third-party services and is not responsible for the information they collect.

Donations

Donations can be made to GeneList through Ko-fi (https://ko-fi.com/genelist). The processing of payments is subject to the terms, conditions and privacy policy of Ko-fi in addition to this agreement. Donations support the running of gene-list.com, are voluntary, and are not a purchase of any service, feature or level of availability.

Intellectual property

The GeneList name, logo and the design and arrangement of gene-list.com are the property of GeneList, Inc. The gene annotations displayed are derived from Ensembl and remain subject to the terms under which Ensembl makes them available. Content belonging to the resources GeneList links to remains theirs.

You may reproduce a list of results you have generated, including in publications, and no permission from GeneList is required to do so. Please cite the underlying resources rather than GeneList for the data itself.

Limitation of liability

To the fullest extent permitted by law, GeneList will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, profits, or research time, arising out of or in connection with your use of, or inability to use, gene-list.com, whether or not GeneList has been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you.

Governing law

These Terms are governed by the laws applicable in the jurisdiction in which GeneList, Inc. is established, without regard to conflict of law provisions, and you agree to the exclusive jurisdiction of the courts of that place for any dispute arising out of or relating to them.
